Jesus and Adultery (John 8): The Question the Old Testament Never Asked

In John 8 and across the Gospels, Jesus transforms the biblical law of adultery from a one-sided property right into a mutual standard of faithfulness.

For a thousand years of Old Testament history, a married man in Israel could not legally commit adultery against his own wife. Because ancient adultery was defined as a property crime against another man, a husband's infidelity was not considered a betrayal of his marriage, and his wife had no legal claim to his fidelity.

In Part 3 of our series on Adultery & Divorce, we explore how Jesus dismantled this ancient system with three revolutionary sentences. In the Gospel of Mark, he makes adultery a two-way street by declaring a man can sin "against her." In the Sermon on the Mount, he moves the boundary of the law from physical acts to the intent of the heart.

Finally, in the famous story of the woman caught in adultery in John 8, Jesus faces a crowd demanding the death penalty. While scholars note this passage was likely added to the Gospel later, it preserves a core truth about his ministry. By demanding that only a man "without sin" cast the first stone, Jesus leaves the law on the books but makes it entirely unenforceable by human hands—saving a woman's life in a system that had always let the man walk free.
