Property Gift Laws in Pakistan: LHC Strikes Down Fake Tamleek | Full Analysis 2026 ⚖️ Pakistan Law Review
The Lahore High Court has delivered multiple landmark decisions on the law of gift (Hiba) and transfer of property, ruling on issues ranging from verbal gifts and inheritance rights to the validity of gift mutations (Tamleek) and the powers of an attorney to gift property. ⚖️ In this video, Pakistan Law Review provides a complete legal analysis of these important judgments, their impact on property disputes, and practical lessons for every citizen.
The law of gift in Pakistan is governed by the Transfer of Property Act 1882 (for Muslims, with certain principles of Muslim personal law) and judicial precedents. Recent decisions of the Lahore High Court have clarified several critical issues:
First, the Court has repeatedly held that the burden of proof for a valid gift lies heavily on the beneficiary. A gift requires three essential elements: declaration by the donor, acceptance by the donee, and delivery of possession. In Sadiqan Begum v. Muhammad Siddique (2025) , Justice Khalid Ishaq ruled that where a gift excludes a legal heir, the donee must prove the original transaction and justify the disinheritance. The beneficiary must take the witness stand himself; non-appearance is an “incurable defect” .
Second, the Court has cracked down on the misuse of oral gifts (verbal Hiba) to deprive women of inheritance. In a 38-year-old dispute, the LHC nullified a Tamleek (gift mutation) that a brother had used to fraudulently deprive his three sisters of their Shariah-mandated share. Justice Malik Javed Iqbal Wains observed: “The Holy Quran unequivocally guarantees the rights of daughters Any attempt to defeat this divine commandment through a dubious transaction is not legally sustainable” .
Fourth, on power of attorney and gifts, the Supreme Court (in a case upheld by LHC principles) has held that an attorney cannot transfer the property of a principal through a gift to themselves or their kith and kin without specific permission from the principal. The attorney must prove that the donor’s intentions and directions were clearly recorded .
