Male: Now, Legal Brief with Bree, featuring Jim Higgins with answers and advice on legal matters.
Female: Thank you for joining us for a Legal Brief. Today we’re going to be talking about what to do if you’re injured on the job and joining me to discuss that topic is Jim Higgins from The Higgins Firm. Thanks for being with us again today.
Jim Higgins: Thank you.
Female: Talk me through some of the cases that you’ve had and kind of, you know, about the individual’s rights if you are injured on the job.
Jim Higgins: Right. Well, you know, Tennessee - every States is different, Tennessee has certain laws that provide you your work comp benefits that you’re title to. I’ll tell you one thing that we’ve noticed in our office is we have not only work comp section, but we also have an employment law section and there are a lot of employment laws that protect your job, protect time off, can help you get your job back that I think a lot of people miss in these cases. And, that’s - those are so important.
Female: Well, things do come up, I mean, there’s cases when you have babies or sickness, and so I guess it’s just knowing what your rights as an individual [00:00:57] that’s so important, when would they need to make a contact to your office?
Jim Higgins: Well, they’re welcome to contact us as soon as something happens, right? I mean, I don't mind talking to people. They don’t always need a law firm like ours, but call us - you know, a lot of times you just to know where your rights are. I’ll tell you a couple of things that they should really watch out for and that is you’re injured at work and you’ve been at the job long enough and it’s big - it is a big enough company, you get what we call Family and Medical Leave rights and that can protect your job to 12 weeks. There’s also rights under the federal laws [00:01:26] Americans with Disability Act that if you’re [00:01:29] go back to work and your employer can make a reasonable accommodation, then you ought to get those jobs back. Those are the two-key federal employment laws that work comp folks ought to know and take advantage of.
Female: Right. Well, I guess, that’s where your [00:01:41] contacting your firm could be so beneficial and just knowing rights in general like you said is so important. If you would like to contact the Higgins Law Firm, you may do so at 423-954-0040 or at tnjustice.com.
