The Impact of the GAO Ruling on BEAD Funding

Last month the Government Accountability Office (GAO) issued a legal opinion stating that the NTIA's BEAD Restructuring Policy Notice that laid out "Benefit of the Bargain" changes to the Notice of Funding Opportunity was subject to the Congressional Review Act (CRA), and should have been run by Congress as part of the Congressional Review Act (CRA). The $42.5 billion dollars in broadband funding in the BEAD program was signed into law in November of 2021 as part of the Infrastructure Investment and Jobs Act to help close the digital divide. Over four years later no funding has been released for the last-mile broadband deployment. The CRA requirement and possible litigation based on the GAO ruling could now further extend the time when States and their broadband operator subgrantees get funding. #BeadProgram #GAOruling #CRA
