11th track from "The Seventh One" (1988). "You still have the freedom to learn and say what you wanna say," sings Joseph Williams in this freedom-loving rock song from the late '80s. But today in 2016, Free Speech is under assault like never before. That's why I've included in this video some pertinent words by Ken Paulson, president and CEO of the First Amendment Center (starts around the 3:20 mark.) More of his comments appear below.

Ken Paulson, president and CEO of the First Amendment Center, says, "If someone posts on the Internet that we should go string someone up and they name that person, and encourage action, that is a different matter. But hateful speech is absolutely protected by the First Amendment."

"I keep hearing about a supposed 'hate speech' exception to the First Amendment, or statements such as, 'This isn’t free speech, it’s hate speech,' or 'When does free speech stop and hate speech begin?' But there is no hate speech exception to the First Amendment."

"Hateful ideas (whatever exactly that might mean) are just as protected under the First Amendment as other ideas. One is as free to condemn Islam — or Muslims, or Jews, or blacks, or whites, or illegal aliens, or native-born citizens — as one is to condemn capitalism or Socialism or Democrats or Republicans."

"For this very reason, 'hate speech' also doesn’t have any fixed legal meaning under U.S. law. U.S. law has just never had occasion to define 'hate speech' — any more than it has had occasion to define rudeness, evil ideas, unpatriotic speech, or any other kind of speech that people might condemn but that does not constitute a legally relevant category."

Still, Harvard law professor Alan Dershowitz warns that "Governments are trying to also make changes to hate speech law and debating the issue in Canada, at the United Nations, and even right now in Israel. It is a worldwide trend, but it is a really dangerous trend."

While Dershowitz believes there is greater freedom of speech today, he noted people tend to be more easily offended and more likely to call for a solution for that offense, which can set a dangerous precedent.

"There is an '-ism' for everything — racism, sexism, fatism — and once you give in to one -ism, every other -ism comes back and asks to be treated the same, too. It can be dangerous to satisfy people's sensitivities," he said, adding that hurtful words used in political and social debates are "far different than the incitement that led to massacres in Rwanda.

"In America, the pendulum swings far too widely in reaction to these events. The proper response to hate speech is to answer that speech more often, not to censor it. The best solution and answer to hate speech always has been to keep the marketplace of ideas open."
