Learn the in's and out's of what the Government must prove in order to establish the charge of theft or shoplifting in Texas. Remember, the Government must prove the case beyond a reasonable doubt and failure to do so can result in your theft case being dismissed.

• Theft u/100 = Citation
• Theft 100-750 = Class B
• Theft 750 – 2500 = Class A
• Theft over 2500 = Felony theft

In order to prove the charge, the State of Texas must prove beyond a reasonable doubt that you
Intentionally or Knowingly permanently deprived the owner of the property without their consent.

Shoplifting charges – your attorney must break down the facts of your shoplifting charges because if Walmart or Target claim you stole something but you accidentally failed to scan an item but scanned everything else or maybe you had not yet passed all points of sale because you were looking at something else – this could cause a problem for the District Attorney in proving the criminal intent element of theft.

First Time Shoplifting – you CANNOT take a plea deal. You need to negotiate a dismissal of the charge or get into a diversion program. Failure to do so could limit your future employment opportunities and could be as negative as being convicted of a felony to many employers.

Theft – even if we are talking about a theft not involving shoplifting, the same elements must be proven beyond a reasonable doubt. The Prosecutors sometimes try to claim bad business deals or unhappy businesses (like Rent-a-Center and other companies) as a victim and arrest good people that have done nothing wrong with the charge of Theft.
