How to build a legal basement apartment in Brampton?
Please note: the information that I am going to share today was acquired from the sources of the city of Brampton also I am not a legal, zoning, or construction expert to give any advice on these topics. I am just going to explain the process of the legalization of a basement apartment in this video.

First of all What is a two-unit dwelling?
A single-detached, semi-detached, or townhouse that contains a 2nd unit that has a kitchen, bathroom, and sleeping area is called a two-unit dwelling.

A 2nd dwelling unit may also be called a basement apartment or an in-law suite. A finished basement can not be legally used as a 2nd unit unless it has been registered with the city.

even where a basement is already finished and has a bathroom, kitchen, bedroom, and living area, You need a building permit. The basement needs to pass the building code in order to qualify as a legal 2nd dwelling.

Only one 2nd unit is allowed in a Detached, Semi-Detached, or townhouse. You can not make a 3rd legal unit in these types of properties. A 2nd dwelling unit is not permitted in the Live & work townhouse, quad townhouse, or back-to-back townhouse.

What are the requirements for a two-unit dwelling?

The 2nd unit must be smaller in size than the primary house.
As per new rules, no additional parking is required for a 2nd unit.

There must be a clear path or way 1.2 meters wide to the main entrance of that 2nd unit from the driveway.

Let’s move on to the registration process.

You need to complete the application for a CHANGE OF USE building permit.

You need to provide fully measured drawings of the basement site plan & Water Pipe Size- Plumbing Datasheet, with measurement of the driveway and location of the Ac unit and window wells.

Is there a fee?
Yes, a $200 registration fee for the Owner-Occupied dwelling.
plus $1020 for a CHANGE OF USE building permit.

Once a completed application is submitted with the required documentation to the city hall.
The city officials review it and then issue the building permit and after that, you can begin the construction of the 2nd unit.

City inspectors will be doing the inspections after each mandatory stage of the construction.

A separate permit may be required from the Electrical Safety Authority for any existing or new electrical work. After the final inspection, you get the occupancy permit from the city.
