The Structural Changes
New Total Strength: The total sanctioned strength of the Supreme Court has been increased from 34 to 38 judges (including the Chief Justice of India).
The Legal Amendment: The ordinance amends Section 2 of The Supreme Court (Number of Judges) Act, 1956, substituting the words "thirty-three" puisne judges with "thirty-seven" (excluding the CJI).
The Ordinance Route: Because Parliament was in recess, the government invoked Article 123 of the Constitution to implement the change immediately via presidential ordinance. The formal Supreme Court (Number of Judges) Amendment Bill, 2026 will be introduced in the upcoming Monsoon session of Parliament to formalize it.
Why Was the Strength Increased?
Mounting Backlog: The primary objective is to tackle judicial pendency. The Supreme Court currently faces a backlog of over 93,000 pending cases.
Regular Constitution Benches: Chief Justice of India Surya Kant had requested the expansion to ensure the apex court has enough judges to routinely form five-judge Constitution Benches for critical constitutional matters without disrupting regular civil and criminal division benches.
Speedy Justice: The addition of four judges is intended to improve disposal rates, ease the extreme workload on sitting judges, and accelerate the delivery of justice.
