Newark, New Jersey Mayor Ras Baraka is no longer facing a federal trespassing charge stemming from a recent incident at Delaney Hall, a privately operated Immigration and Customs Enforcement facility. Acting U.S. Attorney for the District of New Jersey, Alina Habba, announced the decision to dismiss the misdemeanor charge for the sake of moving forward. She invited Mayor Baraka to tour the facility, emphasizing that the government has nothing to hide and offering to accompany him personally.

In contrast, Rep. LaMonica McIver now faces charges for allegedly assaulting and interfering with law enforcement during the same protest. She has been instructed to turn herself in, though specifics regarding the timing are pending. Mayor Baraka expressed support for McIver, calling her a friend and a daughter of Newark, and stated he expects her to be vindicated.

The charges against Baraka and McIver arose from an incident where they, alongside other lawmakers, allegedly rushed through security gates at the ICE facility while protesting. DHS officials asserted that such actions would lead to arrest for an ordinary citizen, underlining that public officials are not above the law.

The situation has ignited political tensions in Newark, particularly as Baraka campaigns in the Democratic primary for governor. His recent court appearance drew supporters who rallied outside the federal courthouse, while U.S. Attorney Habba was present at the conference.
