“It Would Be Almost Sick Praying For A Murder” - Solicitor General of India #courtproceedings
The Supreme Court of India heard the matter on 24 April 2026 before a Bench comprising Hon'ble Justice B.V. Nagarathna and Justice Ujjal Bhuyan.
In a significant ruling, the Court reaffirmed that a woman’s choice is paramount when it comes to continuing or terminating a pregnancy. The Bench allowed the medical termination of pregnancy of a 15-year-old minor who was over seven months pregnant.
The Court categorically held that a woman cannot be forced to continue an unwanted pregnancy merely on the ground that the child can be given up for adoption. Emphasising reproductive autonomy under Article 21, the Bench observed that compelling a woman- especially a minor-to carry a pregnancy against her will would violate her dignity, mental health, and personal liberty.
The Court also warned that denying relief in such cases may push minors toward unsafe and illegal abortion methods. It clarified that constitutional courts must prioritize the welfare and choice of the pregnant woman, even when statutory limits under the Medical Termination of Pregnancy Act have been crossed.
Rejecting suggestions of adoption and financial assistance, the Court underscored that such alternatives cannot override the explicit wishes of the pregnant woman. The termination was permitted at AIIMS, New Delhi, subject to medical safeguards.
This judgment reinforces that reproductive choice is a fundamental right and that courts must view such cases through the lens of dignity, autonomy, and the best interests of the woman.
