Aurora lawsuit against Denver over police misconduct payouts from 2020 BLM protests heading to trial.
Who has to pay for the damages?
Aurora and Denver appear to be headed to trial in September to determine who will pay for police misconduct lawsuits stemming from the 2020 Black Lives Matter protests, with potentially millions of dollars at stake.
When protests erupted in 2020, Denver called on neighboring Aurora for assistance. Aurora sent police officers and an Emergency Response Team to help, but now the two cities are at odds over who bears financial responsibility for subsequent legal actions against officers from both departments.
"The basic theory here is, if we lend you our officers and they are then sued, you, the municipality who requested the officers, are then responsible for any verdict against them and any attorney fees," said Scott Robinson, a legal expert for 9NEWS.
Denver has already paid nearly $15 million in settlement claims from the George Floyd protests. Denver City Council is now set to approve a million-dollar agreement with a law firm to represent the city in its lawsuit with Aurora and other civil rights cases. The agreement is not limited to lawsuits stemming from the 2020 protests.
Robinson emphasized the significant financial implications of the case between Aurora and Denver.
"We're really talking about potentially millions and millions of dollars. This is a significant litigation no matter which way the jury rules," he said.
Court filings indicate the two neighboring cities are not close to reaching a settlement. According to the Denver City Attorney's Office, the city intends to "vigorously defend itself" in the lawsuit filed by Aurora.
The central issue in the case revolves around who was in command of the officers during the protests, according to Robinson.
"The key factual issue in this case is whether the Aurora officers were under the supervision and control of Denver officers or Aurora command and what policies were followed, those of the Denver Police Department or those of Aurora," Robinson explained. "Those are questions that will be decided by a jury if the case is not settled."
Aurora officials reportedly believed Denver would cover legal fees, settlements, and payouts involving Aurora Police Department officers who responded to Denver's request for assistance. Denver officials disagree with this interpretation.
The lawsuit has broader implications for how mutual aid agreements and resource sharing across jurisdictional lines function during emergencies. The law enforcement aid and assist statute permits cities to lend officers to one another, but Robinson noted this situation is unusual.
