In all criminal cases that are felonies, you have a right to a probable cause hearing. If you have not been indicted by the Grand Jury, that means you will have a Preliminary Hearing.

You only get a Preliminary Hearing in Felony cases. It's an extra level of protection given to people who are charged with felonies. Before you can be made to defend yourself in a felony matter a neutral person (judge) will look at all the evidence and decide, not if you are guilty or not, but if there is enough evidence (probable cause) to push the case through the criminal justice system.

In these types of hearings, things like hearsay can be admissible, even though it might not be at your trial. The defense will also have the opportunity to present evidence as well. But, at the end of the day, the judge will be the one who decides if there is enough evidence to move forward and if are you the actual person who has been charged in the case.
