The Delhi High Court has issued notice to the Union government on a PIL challenging provisions of the Assisted Reproductive Technology (Regulation) Act, 2021, which prohibit the donation of surplus frozen embryos to infertile couples. Filed by IVF specialist Aniruddha Narayan Malpani, the petition questions why the law allows donor sperm and egg-based IVF, including cases with no genetic link to parents, but blocks consent-based embryo donation. The plea argues that forcing viable embryos to be destroyed after 10 years instead of permitting altruistic donation is arbitrary, ethically inconsistent, and violates Articles 14 and 21 of the Constitution. A Division Bench led by Chief Justice D K Upadhyaya has sought the Centre’s response, making this case significant for debates on reproductive rights, equality before law, and regulation of assisted reproductive technologies in India.
