Did Brexit Change EU Law?

A Current Legal Problems Lecture delivered on Thursday 25 February 2021.

Speaker: Professor Niamh Nic Shuibhne (University of Edinburgh)

Chair: Professor Ronan McCrea (University College London)

This lecture investigates whether the withdrawal of the United Kingdom from the European Union has changed EU law. At one level, Brexit necessarily animated the law related to and produced by Article 50 TEU itself. But did Brexit imprint too on fundamental premises of EU law that shape relations between the remaining Member States with the Union (and with each other) or between the Union and the wider world? This question will be examined in connection with the development of principles of EU law in a substantive sense as well as the processes and institutional checks and balances that normally apply to the making of it. It will be argued that Brexit has changed in some respects the legal implications of membership of the Union; the legal nature of relationships with third States; and the legal force of political decision-making.
