Interns getting paid! NY Court says Fox Searchlight Pictures must pay interns.

Two former Fox Searchlight interns represented by Outten & Golden LLP filed a Class Action Complaint in New York against Fox Searchlight, the specialty and independent film division of Twentieth Century Fox Film Corporation.

The complaint alleged that Fox Searchlight violated federal and state labor laws by failing to pay any wages at all to unpaid interns who perform the work of production assistants, bookkeepers, secretaries and janitors on films produced and co-produced by Fox Searchlight.

How to know if an intern should be paid:
1. Intern program must be set up similar to an educational or vocational program.
2. Program needs to be for the benefit of the intern. It cannot be for the immediate benefit of the employer. (ex. Employers benefit from an intern making photocopies, getting coffee, booking travel benefit, and would otherwise require a paid employee to complete these tasks. Those interns must be paid.)
3. The intern must know they're not entitled to a job at the end of the program.
4. Both intern and employer must acknowledge at the beginning that there will be no wages.

Whether or not an intern is getting a college credit does not impact the determination of whether or not the employee must pay the intern. The employer must define the parameters of the internship program themselves.

Unsure as to whether or not you should pay your interns? Ms. Abrahamson says you should pay them. Otherwise, seek legal counsel to make sure you are correctly designing your program to fit legal regulations for internships.
