Criminal defense attorney John Guidry discusses a new Florida law update as of October 2019 that increases the felony threshold for shoplifting. The requirement for shoplifting, petit theft, and for grand theft has been adjusted to make it more difficult to recieve a felony when shoplifting, and more common to have the case rules a first or second-degree misdemeanor in Circuit Court.
Before the law was passed, any shoplifting charge where the item that was allegedly stolen was valued at over $300 would be considered grand theft, punishable by up to 5 years in prison and a $5,000 fine. However, the new law ups the price of the item in question to $750 in order to receive a felony, with goods valued less than that resulting in a first-degree misdemeanor. Even further, any stolen item that has a price less than $100, also known as petit theft, will result in a new punishment of a second-degree misdemeanor, which is the lowest possible charge and results in 60 days in jail and a $500 fine.
