Has the Hacking Law Practice had any success with I-130 applications where a son or daughter is seeking an immigration benefit for their mom or dad? Hi, I'm Jim Hacking, immigration attorney practicing law here in St. Louis Missouri. Our office has handled a fair number of family-based visa applications in which a US citizen is sponsoring his mother or his father or her mother or father for a green card, and there are some things that come up in these cases that make these cases particularly interesting. You know, as a US citizen, you have the right to sponsor for immediate relatives for a green card, and that can take place if the parent is overseas or if the parent is in the United States, and we've seen some real success lately in these cases in which the parent is in the United States, and one of the nice benefits that we've been noticing is that the Immigration Service has really been cutting back on the number of interviews that they handle on these cases. We had a client just yesterday receive correspondence in the mail saying that it's unlikely that his case is going to be processed with an interview, that it's probably going to be done all on paper, so that's good news, because in a lot of these situations, the parent is elderly. They don't speak much English and there's really no point in having an interview. One other thing to keep in mind though that this letter also brought out is that right now, in 2014, the Immigration Service is processing these cases pretty slowly and there's backlog on those and they're not because of a particular facts of a particular case, but it's more because they're just overwhelmed and that's another reason why they are only picking and choosing certain ones to schedule for interview, that is apparent cases that they're scheduling for interview. We recently filed a parental visa case, and in that one, it did involve an interview. In that case, a client of ours from Palestine, his mother came to visit him in the United States. He became a US citizen and he filed an I-130 and an I-45 seeking to have his mother adjust status from that of visitor to green card holder, and from start to finish, the whole case took about 6 months. He did have an interview. We went down. We prepared him and his mother for the interview. It was pretty uneventful. We had prepared the client and his mother for the interview, and we just got notice today that the green card had been approved, so we're very excited for our client, for his mother. She's now going to be able to permanently reside in the United States and to stay here with her son. We're happy about that.
