The senior counsel argues that certain incidents concerning the Indian Bar Association are part of the complaint that was first filed before the State Bar Council, then the Bar Council of India, and now form the subject of this revision.

The Bar Council of India is already aware of the serious misconduct allegations. Even if the revision has been withdrawn, and you’re now trying to project something else—there’s clearly more to this than just the appearance of a withdrawal. Since the Bar Council is informed and there’s enough evidence on record of the serious allegations, make a note of this, even though the revision was withdrawn. They’re trying to bring something else before us. There is clearly more than what is being claimed.

Counsel: No problem, Your Lordship. The Bar Council is informed, but it can only act upon a formal application. It requires suo motu powers.

Judge: Exactly.
Counsel: Yes, Your Lordship.
Judge: Then exercise it. We’ll see.

Counsel: Yes, a suo motu power, being exercised a year later—we allow it, Your Lordship. I am placing a Supreme Court judgment on record.

Counsel: This judgment refutes the argument that the Bar Council of India cannot suspend a lawyer from practice until the disciplinary proceedings are complete. The Madras High Court made that ruling, and the Supreme Court upheld it.

Judge: Fine.

Counsel: And in this case, the petitioner received notice of a six-month suspension on September 9.
On September 10, he moved for and received an interim stay.
Judge: So what? The fact that Your Lordship didn’t issue the order doesn’t mean an unrelated party’s order is automatically invalid here.

Counsel: Similarly, the Bar Council of India also placed the petitioner under interim suspension.

Judge: Alright. So interim suspension is within the powers of the Bar Council of India. What is the basis for this? What serious allegations? Which petition?
Counsel: Based on the revision petition. Certainly. But as Your Lordship is aware of the misconduct, the Bar Council of India does have the authority.
