WHERE IS MR. KEJRIWAL? HC JUDGE BIG ACTION......KEJRIWAL TO MOVE SC SOON ? #supremecourtofindia

Can the Government suspend a political party’s Instagram handle without a clear statutory power?
And can a politician boycott a courtroom while simultaneously asking the Supreme Court to transfer the same judge from hearing his case?

This week, the Aam Aadmi Party raised both questions in two different constitutional courtrooms.

In the Supreme Court, AAP challenged the suspension of its Gujarat unit’s Instagram handle, arguing that Section 79(3)(b) of the IT Act was never meant to become a direct content-blocking weapon. Senior Advocate Shadan Farasat argued that the provision only deals with “safe harbour” obligations of intermediaries — not independent censorship powers.

The party says the move violates Article 19(1)(a), the constitutional guarantee of free speech. The Supreme Court has now issued notice to the Centre.

At the same time in the Delhi High Court, Justice Swarana Kanta Sharma appointed three amicus curiae for Arvind Kejriwal, Manish Sisodia, and Satyendar Jain after the leaders chose to boycott proceedings, invoking “Mahatma Gandhi’s Satyagraha principles” and claiming their faith in the court process had been shaken.

But here’s the constitutional twist:
Kejriwal had also moved the Supreme Court seeking transfer of the excise policy case away from Justice Sharma’s bench — even as his legal team withdrew from participation before her court.

This has now created a rare constitutional confrontation involving:
⚖️ Article 19 vs state regulation of digital speech
⚖️ Article 21 vs procedural fairness in criminal prosecution
⚖️ Judicial recusal vs courtroom boycott
⚖️ Free speech, due process, and strategic constitutional litigation

Justice Sharma’s response may become one of the most significant procedural moments in the case: instead of proceeding ex parte, she chose to appoint independent senior advocates as amicus curiae to preserve procedural fairness.

And one line from the Supreme Court hearing may define this entire battle:
“Today my portal is gone.”

Because this is no longer just about an Instagram account.
It is about whether opposition parties in India can lose their digital voice overnight — and what constitutional remedy exists when that happens.
