ISLAMIC SOURCES OF LAW
Islamic law, known as Shariah, is a comprehensive legal system derived from divine guidance and human interpretation. It governs not only religious rituals but also aspects of daily life, including family matters, business transactions, and criminal law. Islamic law is based on the teachings of the Quran and the Sunnah of the Prophet Muhammad (PBUH), along with other secondary sources that provide interpretations and guidelines for new legal issues.
Primary Sources of Islamic Law
The two fundamental sources of Islamic law are:
1. Quran
The Quran is the holy book of Islam and the primary source of Islamic law.
It contains direct commandments from Allah and serves as a comprehensive guide for Muslims in all aspects of life.
Legal rulings in the Quran cover various areas, including worship (Ibadah), social justice, marriage, inheritance, and criminal law.
Example: Prohibition of theft and its punishment is mentioned in the Quran (Surah Al-Ma’idah 5:38).
2. Sunnah
The Sunnah refers to the sayings, actions, and approvals of the Prophet Muhammad (PBUH).
It serves as a practical interpretation of the Quran and helps explain how the Quranic commandments should be applied in daily life.
The Sunnah is recorded in collections of Hadith (sayings and actions of the Prophet).
Example: The method of performing prayers (Salah) is explained through the Sunnah.
Secondary Sources of Islamic Law
When issues are not directly addressed in the Quran or Sunnah, Islamic scholars rely on secondary sources to derive rulings:
3. Ijma (Consensus)
Ijma refers to the consensus of Islamic scholars on a particular legal issue.
It reflects the collective agreement of the Muslim community and serves as a binding source of law.
Example: The consensus on the permissibility of performing Taraweeh prayers in congregation during Ramadan.
4. Qiyas (Analogical Reasoning)
Qiyas involves drawing legal rulings through analogy by comparing new issues with existing ones mentioned in the Quran or Sunnah.
It allows scholars to apply Islamic principles to new circumstances.
Example: The prohibition of drugs is derived through analogy with the Quranic prohibition of alcohol, as both substances cause intoxication.
Other Sources of Islamic Law
5. Istihsan (Juristic Preference)
Istihsan allows a scholar to depart from strict analogy for the sake of public interest or to avoid hardship.
Example: Allowing commercial transactions using modern banking methods, even though traditional rules may not cover them directly.
6. Maslahah Mursalah (Public Interest)
Rulings can be based on public welfare if they align with the objectives of Shariah.
Example: Establishing traffic laws to ensure public safety.
7. Urf (Custom)
Established local customs that do not contradict Islamic principles can serve as a source of law.
Example: The acceptance of certain wedding traditions in different Muslim cultures.
Significance of Islamic Law
Islamic law is not just a legal framework but a complete way of life for Muslims.
It ensures justice, equality, and moral integrity in society.
Islamic law adapts to changing circumstances while maintaining its core principles through the process of Ijtihad (independent reasoning).
✅ Conclusion
Islamic law is rooted in divine guidance and human interpretation, combining spiritual and legal dimensions. The Quran and Sunnah provide the foundation, while secondary sources like Ijma and Qiyas ensure the law remains adaptable and relevant. Through the balance of tradition and reasoning, Islamic law continues to guide Muslims in all aspects of life.
