If Your Child Has an EHCP, Schools Can’t Do This Anymore

If your child has an Education, Health and Care Plan (EHCP), that document isn’t a favour.
It’s not “what we’ll try to do when we have time.” It’s the law.

And once it’s in force, your child’s school and the local authority are legally bound to provide every single thing written in it.
So when schools say things like:
“We can’t provide 1:1 today staff are off.”
“Therapy will start again next term.”
“We’ve changed their timetable to help them cope better.”

❌ That’s not flexibility. That’s a breach of the EHCP.
Here’s what the law actually says:
Under the Children and Families Act 2014, provision in Section F (education, health, and therapy support) must be delivered exactly as specified. No pauses. No substitutions. No budget excuses.

If the EHCP says:
“25 hours of 1:1 adult support per week” → your child must receive those 25 hours.
“Weekly SALT sessions” → those sessions must happen weekly, not “when staff return.”
“A safe, low-sensory learning space” → that environment must be available daily.
You do not need to accept “we’re short-staffed,” “we’ll review it next term,” or “it’s not in the budget.”
Because once it’s in Section F it’s enforceable by law.

If a school is not delivering what’s written, you can:
✅ Raise it with the SENCO (in writing).
✅ Escalate to the Local Authority’s SEN caseworker.
✅ Request an emergency review if support keeps breaking down.
✅ In serious cases, make a formal complaint citing failure to implement Section F.
