What is "Med Arb"? Part 1
Did you know that you can combine mediation and arbitration together to resolve a dispute? Watch family mediator Laura Tarcea and family lawyer and mediator Marty Klein explain what med-arb is, how it works and what to expect in the process.
2:45 Laura and Marty give a refresher on what mediation and arbitration are.
9:50 Laura explains that parties usually have to choose whether they would like to engage in mediation alone, or enter into the med-arb process. However, it is also possible to choose to enter into arbitration separately if mediation alone did not work.
12:38 Marty explains why med-arb has the "finality" aspect that is helpful in some circumstances.
Note that in mediation, the parties craft their own solution, and often feel more "in control" of the outcome. In arbitration, the arbitrator makes a binding decision for the parties, much like a trial judge.
