The matter was mentioned before a division bench, consisting of Justices Tapabrata Chakraborty and Partha Sarathi Chatterjee, on Monday, April 21, 2025. The appeals were assigned to this bench by Chief Justice T.S. Sivagnanam after the matter was previously released by another bench.

The appeals, which include those by the West Bengal Board of Primary Education and several individuals affected by the terminations, were filed against the order of a single bench. The case concerns the termination of jobs for primary teachers, who were recruited in 2016 but had not completed the required teacher training course, despite passing the Teacher Eligibility Test (TET) in 2014. The case will be heard on April 28.

Previously, on April 7, the division bench, led by Justices Soumen Sen and Smita Das De, decided to release the matter from its list of cases for hearing due to "personal reasons" cited by Justice Sen. The case was then assigned to Chief Justice Sivagnanam for reallocation to another bench.

The issue originated from an order by a single bench led by Justice Abhijit Gangopadhyay on May 12, 2023, which cancelled the appointments of nearly 32,000 primary teachers. These individuals had been recruited in 2016 based on their Teacher Eligibility Test (TET) 2014 results, but had not completed the compulsory teacher training at the time of their appointment. A division bench later issued a stay

The outcome of the appeals will be crucial for the affected teachers and the future of the recruitment process in West Bengal's primary schools.
