The subsistence requirement for labor immigrants will soon be raised, from today's SEK 13,000 to SEK 27,360. The government's aim is for the new requirement to apply from 1 November.
- We estimate that around 10-20 percent of those who apply for a work permit do not meet the new wage requirement and will be directly affected, says Anna Lindblad, deputy head of law at the Migration Agency.
The government has proposed to raise the income requirement for those who apply for a work permit in Sweden. Today, the requirement is that you must earn SEK 13,000 a month. From November 1, when the change is proposed to come into effect, you must have a salary of at least SEK 27,360. The sum, which is considered to be a good livelihood for a labor immigrant, is based on the fact that it is 80 percent of the median wage that Statistics Norway (SCB) publishes for Sweden every year. That amount changes annually.

- We are working on preparations for the new requirement to come into effect. We are looking at how the change in law will be applied and how different groups will be affected, says Anna Lindblad, deputy head of law at the Swedish Migration Agency.

The new requirement applies regardless of whether it is part-time or full-time employment. The salary must also be at the level of the collective agreement or practice within the profession or industry, but at least SEK 27,360.

The most recently published median salary at the time of application shall apply to the examination. It is therefore the time of application that will govern which median salary is to be applied.

Extension of permit
Even when applying for an extended work permit, the Migration Agency must check whether the requirement for a good livelihood is met. This applies both if the requirement will be met in the future and if the requirement was met during the previous permit period.

- When applying for an extended work permit, a new assessment is made in relation to the current median salary, says Anna Lindblad.

Facts: New income requirement
Occupations affected
The professional areas that will be mainly affected by the increased supply requirement are service, care, sales, agriculture, gardening, forestry, berry picking, fishing and professions with requirements for shorter training or introduction. These groups usually have a salary that is below the new subsistence requirement.

Exempted from the supply requirement
Workers who are exempt from the new requirement are those who use free movement (citizens within the EU/EEA or are family members of a person who is), those who have or apply for an EU blue card, those who have or apply for an ICT permit , as well as seasonal workers.

Professional coaches and athletes, au pairs, interns within the framework of international exchange or interns with internships related to higher education and researchers will not be covered by the new requirement.

No transition rules
The new maintenance requirement comes into effect on November 1 without transitional rules. This means that those who have already applied for a work permit but have not received their decision before November 1 must have a salary of at least SEK 27,360 if the Migration Agency makes a decision after November 1. This also applies to applications for license extensions.
