Hi, Stefano Molea here, San Diego criminal defense lawyer and partner at the Law Office of David P. Shapiro, where we help good people are gained control of their future when charged with the crime. Let's say that you're charged with a misdemeanor and are exploring ways in which you can get the case dismissed without necessarily having to go to trial. You may have heard of diversion, which is essentially a program where criminal proceedings are suspended for a certain period of time, usually 18 to 24 months, max. If certain conditions are met during this time and programming is completed successfully, the entire case can get dismissed and it's like it never happened for the most part.

In other videos, I have talked about military diversion and mental health diversion. Now there's a new type of diversion that the judge can craft on his or her own thanks to penal code section 1001.95. A judge can now take a defendant through a program of the judge's design for up to 24 months. If compliant, charges get dismissed and it's like the arrest never happened, again, in most scenarios. The only charges that are not allowed for diversion under PC 1001.95 are alleged violation of penal code section 273.5, domestic corporal injury, 243e domestic battery, 646.9 stalking, or anything that would require sex offender registration under PC 290.
