Bill Cash and ERG say back the Brexit Deal! (4k)

Back the Brexit Deal say Tory ERG MPs!

So the members of the Tory Eurosceptic' European Research group' or ERG has given the Boris Johnsson Brexit deal their blessing and advised their fellow MPs to vote for it.

In a Zoom meeting this afternoon the ERG decided that the new UK-EU Agreement does meet the requirements of the UK regaining its Sovereignty. Something that will obviously be a massive fillip for the Prime Minister.

The ERG put out a simple statement saying:

"The FTA is consistent with restoration of UK sovereignty.

"ERG officers have recommended members vote for the deal."

And one ERG member, Andrea Jenkyns Tweeted:

"The ERG Plenary meeting has concluded. A massive thank you to @BillCashMP and the #StarChamber for their work on this. The #ERG officers have recommended that we should support this deal as it respects British Sovereignty. Here's to a bright future for Post-Brexit Britain."

The ERG's Legal Advisory Committee headed up by Sir Bill Cash put out a short report the first section saying that:

"The essential question before us is the following: is the Agreement sovereignty compliant as a matter of Law? We have concluded it is for the following reasons:

"The Agreement reaffirms the sovereignty of the United Kingdom.

"There is an independent arbitrator panel for any disputes.

"The meanings of the provisions are autonomous under international law and do not reference EU law or the European Court of Justice. Nor does the Agreement provide a role for the ECJ (except for EU programmes which the UK chooses to opt into) and the EU approach of provisions having "direct effect" in UK law is excluded.

"The Agreement contains a provision for termination on 12 months' notice.

"During the operation of this Agreement, the UK remains free to make its own laws, subject to potential tariff and trade consequences if these significantly distort trade between the UK and the EU.

"The UK cannot be subject to arbitrary or disproportionate retaliation unrelated to effects on trade."

And after consideration of things like subsidy control, non-regression, fisheries, Northern Ireland, criminal justice and human rights, the report concludes with:

"Our overall conclusion is that the Agreement preserves the UK's sovereignty as a matter of law and fully respects the norms of international sovereign-to-sovereign treaties."

So with the ERG onboard this deal is now unstoppable and will become law by tomorrow evening.

All I'm waiting for is sight of the Bill that will become the enabling Act for the Agreement.

Now Professor David Collins, Professor of International Economic Law at City, University of London and a WTO specialist, has published his assessment of the deal on the website politeia.co.uk and says:

"The UK-EU Trade and Cooperation Agreement (TCA) achieves very much what the Prime Minister promised last year – it is a very good Free Trade Agreement."

And he also says:

"The TCA is a trade treaty between fully sovereign trading partners and must be interpreted by international trade lawyers who are well-versed in this landscape and its specific legal terminologies. EU concepts such as 'integration' and 'ever closer union' have no bearing on how this document should be interpreted, implemented and enforced."

And to be sure, there will definitely be those that will do their utmost to try and lever the UK back into the EU orbit of legal influence.

And many of them sit as MPs and are queueing up to oppose and vote against this Bill.

On top of the SNP that I talked about this morning, there will be a chunk of Labour rebels disobeying Keir Starmer's instruction to back the deal.

Then there's Ed Davey's Lib Dems and Plaid who have decided to vote against it.

And now the Green Party MP Caroline Lucas has also decided to go through the 'No' lobby.

And just remind everyone, it was only last year that Lucas was calling for a top ten cabinet of female MPs to form a cabinet of national unity to stop a no-deal Brexit.

Now she's Tweeting:

"Tomorrow I'll vote against #Brexit deal

"At time of climate & nature emergency, I will not acquiesce in lower environmental standards"

BBC reports that:

"The DUP MP Sammy Wilson has rejected suggestions that Northern Ireland's place within the UK will be jeopardised by the new Brexit arrangements."
