Timeshare sales organizations know how to paint a pretty picture even if the product isn’t an exact match. Nobody cheerfully pays for something that they can’t use in the way they envisioned. A majority of owners never planned on making a purchase of this magnitude. They were misleadingly sold on an affordable vacation package that conveniently allowed them to travel with family or loved ones every year. When they find out that the actual costs are nearly double and verbal promises of the sales presentation don't match their signed contract, they quickly become angered by a sense of mistrust and deception. Once the rescission period passes and buyers are locked into a perpetual agreement, timeshare companies can basically do as they please. This causes many new buyers to immediately seek out restitution as they feel they’ve been severely wronged.

Even though legally pursuing the timeshare may feel like the best option, it can easily turn into the worst-case scenario.

When it comes to battling the timeshare company in court, you have to realize the sales organization has a plan in place to protect themselves. Their pockets are far deeper than yours are. Unless you have an exceptional case against the timeshare company, your word against the executed purchase agreement is not promising.

Litigation attorneys usually require hefty retainer fees (deposits) that go towards researching your claims and building your case. As they expend hours working on the case, the retainer account continuously needs to be replenished. It’s kind of like taking your car to a mechanic to see what’s wrong with it. You pay the shop for the labor and parts while they attempt to fix your car trouble.

-You have them assess your situation and give them permission to go to work

-Your bill continues to rack up charges

-How much money are you willing to spend to fix the problem before you give up?

It’s important to keep in mind that lawsuits are rarely predictable. In other words, no attorney will ever guarantee to win a case. It can be devastating if the outcome isn’t favorable. Especially when the timeshare counter sues to recoup the money they spent on their own attorney’s fees. That’s an unsettling list of expenses, especially when the timeshare obligation remains.

Taking legal action against the timeshare company may seem like the right thing to do, but it’s a hit or miss strategy.
