This video is on comprehensive sickness insurance for EU nationals looking to secure settled status and also then naturalise as British citizens. Applicants who have been studying or self-sufficient and did not have comprehensive sickness insurance (CSI) should remember that SCI is a legal requirement for EU, EEA and Swiss students, self-sufficient persons and their family members who are residing in the UK with them. The form asks the applicant if they had comprehensive sickness insurance during their time spent in the UK. Those who answer 'no' should have provided an explanation in the box provided.This will include people who previously applied for permanent residence and were refused on the basis of not having CSI. Where someone has been granted ILR under the EUSS but has not been resident here in accordance with the EEA regulations (prior to grant of pre-settled status or settled status) due to a lack of comprehensive sickness insurance the Home Office will consider whether it is appropriate to exercise discretion in your favour. Some applicants will have previously had an application for a document to confirm their permanent residence refused, on the basis of not having CSI. The Home Office will assess the reasons given for this, and why you did not then obtain it, and consider whether there are compelling grounds to exercise discretion in your favour.

EEA or Swiss nationals and their family members granted indefinite leave to enter or remain (settled status) under the EU Settlement Scheme The EU Settlement Scheme allows EEA and Swiss nationals and their family members who are resident in the UK prior to 31 December 2020 (or future family members who join a resident EEA or Swiss national after 31 December 2020 where the relationship existed at that point and continues to exist) to obtain the UK immigration status they need in order continue living and working in the UK after 30June 2021. EEA and Swiss nationals only need to complete 3 key steps as part of their application to the scheme –prove their identity and nationality, show that they were resident in the UK and Islands by 31 December 2020, and declare any criminal convictions.

Where the applicant chooses to provide their National Insurance number, their presence in the UK will be assessed on an automated basis using data held by HM Revenue & Customs and theDepartment for Work and Pensions.An EEA or Swiss citizen or their family members who have a 5years’ continuous qualifying period of residence in the UK and Islands when they apply to the EU Settlement Scheme will be eligible for settled status(provided they also meet any other relevant eligibility and suitability criteria).Those with a continuous qualifying period of less than 5 years’ will be eligible for pre-settled status (provided they also meet any other relevant eligibility and suitability criteria).

A person who is granted pre-settled status can then apply for settled status as soon as they meet the eligibility criteria for it.

However, this grant of settled status (also know as indefinite leave to enter or remain) will not confirm that they were here lawfully under the EEA Regulations during that time, as defined by the British Nationality Act 1981as this is not a requirement of the EU Settlement Scheme.

The naturalisation application form (Form AN) asks for information to confirm the applicant was lawfully in the UK for the relevant 3 or 5year qualifying period. A person granted pre-settled status may have dual running rights under both UK immigration rules (in accordance with their grant of pre-settled status)and the EEA Regulations during their residence–once granted pre-settled status, they will not need to demonstrate that they were exercising a treaty right.
