1) 5 year route to Settlement

For Example, a person has come in to the UK with Entry Clearance such as, on a spouse visa for 2.5 years and has an extension in the UK for 2.5 years where their circumstances remain the same (For example, remain married and the same financial requirements etc). Before the visa expires, the spouse makes the settlement application under the 5 year route. The documents require at present: English language test, life in the UK test, documents support living together with the sponsor, relatives, etc.

2) 6 year route to Settlement

The person who comes in the UK with any visa/overstayer, The Home Office later grants them with a 3 years Discretionary Leave to Remain and the period of the BRP card is for 3 years. The person has 3 years Discretionary Leave and makes an extension application for Discretionary Leave, it’s granted and then can apply for Settlement after completing 6 years Discretionary Leave. The person does not need English Language test and does not need Life in the UK.

3) 10 year route to Settlement

A person who comes in the UK as a spouse and goes for an extension but can not meet the financial requirements for example, The Home Office will not refuse the person but will give 2.5 years Leave to Remain under the 10 year route. For example where a child is involved 3 extensions after the initial application, before his / her visas expire, the person would make an application for settlement. The person would have to provide B1 English language test and life in the UK test as the Law stands now.

Note: When a person has lived in the UK for 20 years unlawfully and they make the application to the Home Office and if the application is successful, The Home Office will grant them 2.5 years Leave to Remain because The Home Office will put them on the 10 year route.
