Supreme Court Changes Stand In NCERT Judiciary Case

The Supreme Court has partially modified its earlier order in the NCERT judiciary corruption chapter controversy. Earlier this year, the Court had strongly objected to an NCERT Class 8 Social Science chapter titled “Corruption in the Judiciary,” calling it biased and damaging to the image of the judiciary. The bench led by Chief Justice Surya Kant had ordered an immediate ban on the chapter and directed that the three academicians involved — Michel Danino, Suparna Diwakar, and Alok Prasanna Kumar — should not be associated with government-funded academic institutions.

However, the Supreme Court has now softened its stance. During the latest hearing, the bench comprising Surya Kant, Joymalya Bagchi, and Vipul Pancholi acknowledged that there was no malicious intent behind the chapter and that it was prepared collectively. The Court withdrew its harsh remarks against the academicians and clarified that state and central governments can independently decide whether to engage them for future academic work.

At the same time, the Court repeated that the chapter portrayed corruption as a judiciary-specific issue while ignoring the positive role of courts and legal aid systems. According to the bench, the content presented an incomplete and unnecessary negative image of the judiciary.
