In this short, we cover the NCLAT judgment in Rajesh Landmark Projects Pvt. Ltd. (2025), where the key question was: Can an IBBI circular override Section 34 of the Insolvency and Bankruptcy Code (IBC)?
The NCLAT held that:
✔️ RP shall be appointed as liquidator unless specific grounds under Section 34(4) exist.
