Save Money Thanks To New EU law General Data Protection Regulation (GDPR)

On the 25th May 2018 New legislation comes into effect call the GDPR, this is going to have many impacts on businesses of all sizes and on people in general.

So how is this going to help save money?

Well it comes down to the combination of companies offering introductory offers, and the fact that the new legislation gives the right for all personal data to be erased by the company upon instruction of the person.

As I keep an eye on the shave subscription market, I will use this as the example; however it applies to all companies and so is applicable across the board.

Shave subscriptions will often entice customers to try the product with an introductory offer, for example and this is easily shown from a simple internet search and their adverts.

As you can see the adverts say they start at just 50p, with the most expensive trial being only £5 and everything in-between.

What is clear is that all these introductory offers are below the cost of service and rely on you continuing the subscription after wards at a much higher rate.

Now this is where the GDPR come in. It states that you can request your details to be deleted which is known as ‘the right to be forgotten’ and as paragraph 59 states ‘The controller should be obliged to respond to requests from the data subject without undue delay and at the latest within one month and to give reasons where the controller does not intend to comply with any such requests.’

This means that after taking the introductory offer, you can cancel your subscription and request that all your persona data is erased. They have to comply with this within the timeframe of the legislation which is at most one month, after which you are then able to reorder the introductory offer again and make the saving again.

What if the company denies the introductory offer on the grounds that you have already previously been a customer? This action would then clearly show that the company has broken the law by not only failing to erase your personal data but by then processing that data again. The company could then be hit with legally binding fines and / or other sanctions from the governing watchdog after you report it. Cleary a company that does this systematically and receives many reports will then incur more stringent penalties.

Does this mean introductory offers will stop? I do not think they will, because they are shown to be a well proven mechanism for gaining customers who then repeat purchase afterwards at higher prices. This sales tactic relies on what is called ‘inertia selling’, and this inertia also applies to people not bothering to erase their personal data from companies, for many it is too much effort, but a few will certainly take advantage of this new legal loop hole.
