Background
The Constitutional Court on 8 May 2026 found that Parliament acted irrationally in December 2022 when it rejected the referral of a Section 89 panel report to an impeachment committee, and instructed the National Assembly to resume the process. The Citizen
The previous Section 89 panel found that Ramaphosa may have a prima facie case to answer after a large amount of foreign currency allegedly hidden in a sofa at his Limpopo farm was stolen. The panel also raised concern about Ramaphosa's explanation that the money came from the sale of buffalo to a Sudanese businessman, and questioned why the theft was allegedly investigated without an official police case being opened. Ramaphosa's Legal Challenge
The election of the chairperson comes as President Ramaphosa heads to court to request a judicial review of the Section 89 Independent Panel Report, arguing that the panel misunderstood its mandate and the legal threshold required under Section 89 of the Constitution. However, political analysts and parties maintain that Ramaphosa's legal bid will not stop the impeachment process, as the review does not challenge the Constitutional Court order requiring Parliament to proceed. The CitizenIOL
Even if the committee recommends impeachment, the president would still likely survive a vote in the National Assembly, where a two-thirds majority is required to remove him from office — and his ANC retains more than one-third of the seats. Al Jazeera
