Ajayi v. R.T. Briscoe (Nigeria) Ltd (1964): Suspension of Rights Under Promissory Estoppel
In Ajayi v. R.T. Briscoe (Nigeria) Ltd (1964) 3 All ER 556, the Privy Council held that promissory estoppel may suspend a party’s strict legal rights where the other party has relied on a promise. However, if the circumstances that justified the suspension cease to exist, the promisor may revive and enforce those rights upon giving reasonable notice. The case clarifies that promissory estoppel is generally a shield, not a sword.
