Amnesty application, does one exist at this point? This content was inspired by Bim. Thank you so much Bim for raising this to our attention. Again, there are text messages going around to say that certain applications can be made for amnesty or if someone has lived in the UK unlawfully for 10 years can be made, or a Windrush application.

One, is an application for Amnesty? The answer is no. Two, the text message says that this application GET (P) can be made. This application does not exist. The text message also said application SET (P) can be made. 'SET' stands for Settlement and P stands for protection. This application is for people who have been granted Refugee status by the Home Office for five years and when they have completed that five year; one month before they make thesettlement application, they don't make it because they have been in the UK for ten years unlawfully. There is no application which has a prospect of success if the person has been in the UK for 10 years because the requirement at present is 20 years unlawful stay in the UK.

Finally, Windrush. The text message also said that a Windrush scheme / application can be made. Windrush is for people who came in the UK long time ago and they had no documents. So, the Home Office considered that these people should not be lost and as such established the scheme and the requirements for the scheme are three. One, the person is entered in the UK before 1973 from a Commonwealth country or entered in the UK by December 1988 from any country and would now be settled. So, it is not for people who are in the UK unlawfully for say 10, 12, 15 years because requirement is still 20 years residence.

So, if you have received this text messages saying make an application, Home Office giving visas silently, that is not true. There is no amnesty application, there is no settlement SET (P) application for people who have been unlawfully in the UK. There is no GET (P) application because it particularly does not exist and as I explained, the Windrush application is for the people who came in the UK long time ago such as 1973, 1988, so it is not for the UK who are in the UK for less than 20 years.

Now, I hope that this newsletter will protect you from falling into this trap of making applications for amnesty because there is no application for amnesty right now.
