Trump DHS Bans Bond for All Illegal Immigrants. Board of Immigration Appeals.

The Board of Immigration Appeals just banned all immigration judges from granting bond to illegal immigrants. First time in US history.

Bond was the mechanism. Under the old system, an immigration judge could grant bond to someone detained after illegal entry. They post bond, they are released into the country while they wait for their immigration hearing. Except a significant number of those people never show up to the hearing. They disappear into the country. Deportation becomes nearly impossible.

Under Biden, this process was used at enormous scale. It was one of the primary mechanisms through which millions of people were released into the United States. Catch and release had a legal structure. Bond was part of it.

That structure no longer exists.

The Board of Immigration Appeals, the highest administrative body for interpreting immigration law in the United States, ruled for the first time in American history that immigration judges no longer have the authority to grant bond to undocumented immigrants who entered without authorization.

Mandatory detention until deportation. No bond. No release. No disappearing before the hearing.

Trump DHS. The directive is in effect.
