“Speedy Trial is a Fundamental Right of the Prisoner: SC” #courtproceedings
The Supreme Court of India heard the matter on 29 April 2026 before a Bench of Hon'ble Justice J.B. Pardiwala and Justice Ujjal Bhuyan.
A deeply disturbing case came up where an undertrial prisoner remained in jail for over 9 years without conviction. Arrested on 7 March 2017 in connection with a case involving serious charges under the Indian Penal Code (including Section 302), the accused continued to languish behind bars while the trial dragged on.
Despite all witnesses being examined and the case reaching the stage of final arguments, bail was denied by the Allahabad High Court. The Supreme Court strongly criticized this approach, calling it a “very shocking matter” and emphasized the violation of the petitioner’s right to a speedy trial under Article 21 of the Constitution of India.
The Court reiterated that the right to speedy trial is a fundamental right, and any prolonged delay—especially when not attributable to the accused—amounts to a serious infringement of personal liberty. It made it clear: no matter how grave the offence, an undertrial cannot be kept in custody indefinitely.
Calling it a gross violation of fundamental rights, the Court ordered immediate release on bail, stating that the petitioner cannot be kept in jail “even for one more day.”
