कितना भी बड़ा अपराध क्यों न हो, 7 साल से कम उम्र के बच्चों को कानून सज़ा नहीं देता।
भारतीय न्याय संहिता (BNS) की धारा 20 के अनुसार यदि कोई बच्चा 7 वर्ष से कम आयु में चोरी, मारपीट या हत्या जैसा गंभीर अपराध भी कर देता है, तो उसे दंडित नहीं किया जा सकता।
कानून मानता है कि इस उम्र में बच्चे में सही-गलत समझने की परिपक्व बुद्धि विकसित नहीं होती।
यह नियम बच्चों की सुरक्षा और सुधार की भावना पर आधारित है, न कि सज़ा पर।
