Juan Cruz appeared in court with his attorney, Christine Brown, while the State was represented by prosecutor Ashley Jones. Both sides confirmed they had exchanged discovery, and the State moved to amend the indictment—correcting the spelling of the pseudonym “Hailey,” fixing a typo, and dismissing all counts except Count Three. The defense raised no objections.
Cruz confirmed he had reviewed the indictment, admonishments, waivers, plea paperwork, and his rights. The judge emphasized that aggravated sexual assault of a child is a first-degree felony with a punishment range of 5–99 years. Cruz acknowledged understanding his rights, the consequences, and that he was pleading freely without threats or promises.
Both attorneys agreed to a plea bargain: 25 years in prison, a $1,500 fine, Chapter 62 sex-offender registration, and no contact with the complainant. Cruz also waived his right to appeal.
During questioning, Cruz apologized, though the judge pressed him for clarity. The court questioned inconsistencies about how Cruz met the child's mother, how long they knew each other, and how quickly he moved into the home. The defense argued the mother routinely relied on Cruz for childcare due to her night-shift job. The judge allowed limited exploration of past allegations within the household, but ultimately focused on the current offense.
The judge formally found Cruz guilty based on the evidence and accepted the plea agreement. She ordered no residing with minors and no unsupervised contact with children after release.
Off the record, the judge delivered a stern lecture, stating that although some parents fail to protect their children, that does not excuse Cruz’s actions. She emphasized that as a registered sex offender, Cruz cannot live or stay anywhere children are present—even with future partners.
Cruz acknowledged these restrictions.
