Probation Violation Hearing? A former D.A. tells what to expect

Faced with a probation violation hearing? In this video, a California criminal defense lawyer walks you through the process. We explain how it is similar in some ways but different in others from a jury trial.

At a probation violation hearing, there is no jury. A judge presides and makes the decision. The district attorney presents evidence, and a defense lawyer represents the accused. If the person is found to have violated probation, the judge has discretion to impose up to the maximum sentence for the underlying crime.

In practice, a good California criminal defense lawyer can often "win" a probation violation hearing. And even if a violation is found, the attorney can often persuade the judge merely to "revoke and reinstate" probation (i.e. give the client another chance) rather than impose jail or prison time.
