Is a Revocable Trust a Private or Public Document?

In this video, Attorney Shadi Shaffer explains that estate planning documents - Revocable Trusts, Wills, Power of Attorney for Financial (aka Durable Power of Attorney), Healthcare Directives, Living Wills, and other estate planning documents you can create or private. These documents are not generally filed with the Court and are not public documents. Estate plans remain private generally speaking until the creator or grantor passes away. Even at time of passing, the Will is filed with the Court but the Trust remains private unless a legal proceeding is filed involving the trust. Another reason why revocable trust plans are wonderful tools to have for your family. They are private and can keep your asset information and how much you are leaving to your kids or beneficiaries private as well. When you do not have a trust and have a CA Probate case - all your assets and information on who gets your assets becomes public.
