Did the JATS Joint Decision Change SCHADS Sleepover Pay Rules

The JATS Joint Decision has sparked questions across the sector about how sleepover shifts are interpreted under the SCHADS Award, particularly for NDIS support workers.

A common question is what happens if a support worker wakes during a sleepover shift. Under the current SCHADS Award provisions, a worker who is required to wake during a sleepover is generally paid a minimum of one hour of overtime at the applicable rate. If there are multiple wake-ups during the same sleepover shift, those periods are typically aggregated to calculate the first-hour overtime payment. Minimum engagement rules may also apply to shifts worked before or after a sleepover.

The JATS Joint case is still subject to appeal, so the final outcome and any resulting changes to SCHADS Award interpretation are still developing. Payroll teams and NDIS providers should stay informed as further updates emerge.
