The Fearless Fund recently shared on their company #linkedin page regarding a dismissal of their case:

The backstory, the lawsuit was settled on September 11th, 2024. The AAER, led by conservative activist Edward Blum, filed a lawsuit claiming that the Fearless Fund's grant program violated the 1866 Civil Rights Act.The Fearless Fund settled the lawsuit and closed the Strivers Grant program.
The 11th Circuit Court of Appeals ruled that the AAER was likely to prevail in the lawsuit. The court concluded that the grant program was not constitutionally protected and was more akin to practicing racial discrimination, which is not protected under the First Amendment.

The Fearless Fund plans to launch a new debt fund to continue supporting entrepreneurs in need of capital.

The settlement is considered a notable defeat for DEI efforts by nonprofits. Some charities and foundations are changing their programs to avoid costly lawsuits, while others are settling litigation.

Attoney's for The Fearless Fund said they made the decision to settle before courts could rule on the case and potentially set a precedent for other anti-DEI lawsuits.
