Unleashing New Police Tech: The House Passes H.R. 2189

What is H.R. 2189, and why did the United States House of Representatives just pass a major bill to stop the federal government from legally classifying police tasers as actual firearms?

In this quick Simply Civic breakdown, we explain House Bill 2189 (H.R. 2189), officially titled the "Law-Enforcement Innovate to De-Escalate Act." Introduced by Representative Scott Fitzgerald of Wisconsin, this legislation tackles a massive, unintended legal loophole created by outdated federal gun laws and rapidly advancing police technology.

Under the Gun Control Act of 1968, any weapon that uses an "explosive" to expel a projectile is legally classified as a firearm. Recently, new, highly effective less-lethal police tools—like the TASER 10—were designed using a tiny explosive primer to launch their electric probes. Because of the 1968 law, the government was forced to legally classify these tasers as "firearms," subjecting them to strict background checks, massive federal gun taxes, and extreme bureaucratic red tape. H.R. 2189 fixes this by officially amending the law. It creates a brand new legal category called a "less-than-lethal projectile device" for tools that fire below 500 feet per second and are not designed to kill, permanently exempting them from strict federal firearm regulations.

Supporters of the law, including the Fraternal Order of Police, championed it as an absolute necessity to save lives and protect communities. They argued that classifying a 100% non-lethal taser as a deadly firearm is completely absurd. Bipartisan lawmakers insisted that taxing and restricting these devices prevents local police departments from upgrading their technology, ultimately making it harder for officers to successfully de-escalate dangerous situations without using deadly force.

Opponents criticized the bill, arguing that rolling back ATF oversight and deregulating weapon classifications can have dangerous, unintended consequences. Critics and gun-control advocates warned that explicitly removing background checks and federal tracking for projectile weapons that use explosive charges could create a massive legal loophole. They expressed concerns that domestic manufacturers could exploit this new "less-than-lethal" definition to design and sell dangerous, unregulated projectile weapons directly to the public without standard safety protocols.

Following a highly polarized debate over gun regulations and police funding, the legislation was successfully passed by the House of Representatives in February 2026, sending it over to the Senate!
