Should you be concerned if the vocational witness at your hearing identifies jobs that you could perform in response to the judge's "hypothetical questions?"

In this clip from a recent Wednesday night livestream I discuss the role of a vocational expert witness in a Social Security disability hearing.

As we discuss, Social Security disability judges often ask expert witnesses called "vocational experts" or VEs to answer questions about your capability to work.

The vocational witness is not there to help you or hurt you. Instead, the VE will help the judge decide if the limitations arising from your medical conditions would permit you to work.

Many judges ask two, three, four or more hypothetical questions. As your attorney I can also ask questions to the VE. Our goal is to include so many restrictions in the question that the VE will answer "no jobs" as his/her answer.

The judge will choose one of these questions as being reflective of your limitations (also called your residual functional capacity). We won't know which hypothetical the judge will go with until the decision is issued.

In preparation for your testimony I ask my clients the questions that the judge will likely ask and work with my client to answer accurately and clearly. This will improve our chances of success at your disability hearing.
