WATCH: Rubio asks if Trump conviction would set precedent | Second Trump impeachment trial

Trump’s lawyer, Michael van der Veen, and Rep. Jamie Raskin, D-Md., responded Feb. 12 to a question from Sen. Marco Rubio, R-Fla., on the impact of disqualifying Trump from running for office. Trump has been charged with inciting an insurrection and was impeached in the House in January, while he was still in office.

Rubio said that disqualifying Trump would set a new precedent, and asked if the new precedent could be used for a future House facing political pressure to impeach a former secretary of state in order to “lock her up,” seemingly referring to Hillary Clinton, Trump’s opponent in the 2016 election.

Raskin said the hypothetical Rubio detailed “has no bearing on this case because I don’t think you’re talking about an official who was impeached while they were in office for conduct that they committed while they were in office.”
