Litigation Finance is not Fee Splitting

This course will explore the particular ethical issues raised by litigation finance and how to address them. We will analyze the ABA's Best Practices, court decisions, and ethics opinions pertaining to litigation finance. This course will also discuss the doctrines of champerty, maintenance, and barratry, as well as these, which have fallen by the wayside, opening the way for a maturing within the market. The lecture will include an analysis of case law governing disclosures, privilege, conflicts, and apportioning of duties & responsibilities in litigation.
