How to protect a trademark in the UAE?

To protect a trademark in the UAE, the trademark owner needs to follow these steps:
Step 1: Search the trademarks registry before applying for a trademark. This will help the trademark owner to ensure that their trademark is unique and distinctive.
Step 2: Register the trademark with the Ministry of Economy (MOE). Every trademark that is registered is given trademark protection in the UAE.
Step 3: Monitor the marketplace regularly for any trademark infringement and take prompt legal action to prevent further infringement.
Step 4: The Trademark owner can take legal action against any person who counterfeits or imitates the trademark in a way that deceives the public regarding the goods or services for which the original trademark is registered, by filing a complaint to the MOE or a lawsuit in the court.
Step 5: The Trademark Law impose penalty of imprisonment and a fine of no less than (100,000) one hundred thousand dirhams and not more than (1,000,000) one million dirhams, or either of these two penalties, on whomever:
1. Forges or counterfeits a trademark registered under the Trademark Law that causes public confusion about the goods or services that the original trademark identifies.
2. Knowingly uses a forged or counterfeit Trademark for commercial purposes.
3. Applies a Trademark that is owned by others on his goods or uses it for the services he offers, in bad faith.
4. Possesses tools or materials with the intent of using them to forge or counterfeit registered or well-known Trademarks.
5. Knowingly imports or exports goods bearing a forged or counterfeit Trademark.
Step 6: The registration of a Trademark grants a protection period of (10) ten years, commencing from the date of filing the application. Renew the trademark every ten years by paying the renewal fees. This will ensure that the trademark remains valid and protected.
