Judge slams 'unconstitutional' search of Luigi Mangione's backpack, allows gun evidence to stay

A New York judge on Monday sharply criticized Pennsylvania police officers for conducting what he called an unconstitutional search of Luigi Mangione’s backpack after his arrest in the killing of UnitedHealthcare CEO Brian Thompson, while still allowing prosecutors to use the alleged murder weapon recovered later at the police station.

Judge Gregory Carro issued the highly anticipated ruling ahead of Mangione’s state murder trial, which is scheduled to begin in September.

Carro directly condemned the initial search conducted inside a McDonald’s in Altoona, Pennsylvania, where Mangione was arrested five days after Thompson was gunned down outside a Manhattan hotel.

“The search of the backpack in the McDonald’s was an improper warrantless search,” Carro said from the bench.
