The Supreme Court of India reminded that it is the Constitution—not Parliament—that is supreme in a constitutional democracy. A bench of CJI Sanjiv Khanna and Justice Sanjay Kumar emphasized that judicial review is a constitutional function and not overreach. This strong message comes in light of Vice President Jagdeep Dhankhar’s remarks accusing the judiciary of acting like a “super Parliament.” The Court called the comments by MP Nishikant Dubey against the judiciary “absurd” but chose not to initiate contempt action.
